General Terms and Conditions

That’s why you can see my general terms and conditions here, which are an integral part of my contracts with you.

Booking of coaching sessions / workshops / seminars / meditation evenings

1. scope of application, general

The following General Terms and Conditions apply to the use of all workshops, coaching sessions and other events offered by Be You – live Your essence in accordance with the contract concluded between me and the customer. Any terms and conditions of the customer that contradict or deviate from my terms and conditions are null and void. Unless the deviations have been worked out in writing with the customer and have received my approval.

2. obligation of the client to cooperate (in the case of coaching)

Coaching takes place on the basis of the preparatory discussions held between the parties. It is based on cooperation and mutual trust. I would like to point out that coaching is a free, active and self-responsible process and that certain successes cannot be guaranteed. The coach assists the client as a process facilitator and supporter in decisions and changes – the actual change work is done by the client. The client should therefore be willing and open to dealing with themselves and their situation.

3. terms of payment

Private individuals: Individual coaching sessions are payable in cash. Companies: Receive an invoice, payable within 20 days. The amount shown on the invoice is to be paid either in cash or to the bank details provided via online banking.

4. expenses

For meetings outside Basel, travel time will be charged at an hourly rate of CHF 100. Half-fare tickets (1st class) will be charged for train travel.

5 Cancellation conditions / Cancellation costs

Coaching sessions: Cancellation of the coaching session free of charge is possible up to 24 hours before the appointment. Cancellations are accepted by e-mail, telephone or text message. Otherwise the full amount will be charged. In the event of illness, a free cancellation is possible up to 12 hours before the start of the appointment. After this time, 50% of the agreed hourly rate will be charged. For missed appointments without cancellation, the full amount will be charged regardless of the reason. Workshops, seminars, lectures, meditation evenings and other courses that take place in the seminar room of Be You- live Your essence: Upon registration, the customer will be guaranteed a place. Cancellation free of charge is possible up to 24 hours before the start of the respective event. Otherwise the full amount for the respective event will be charged. Workshops, seminars, lectures and other services for companies: Up to 5 working days before the start of the order, I will charge my effective preparatory work including expenses (according to the agreed daily rate for implementation). In the event of withdrawal less than
5 working days before the start of the order, at least 50% of the offer amount will be charged. The total amount will be charged after the start of the order.

6. confidentiality

I undertake to maintain unlimited confidentiality towards third parties about all operational, business and private matters of the client that become known to me in the course of my work, even after termination of the contract.

7. liability

My activity is purely a service activity. Success is neither guaranteed nor owed. Any liability is excluded. The dispatch or electronic transmission of any data is at the risk of the client.

8. copyright, terms of use

The copyright to all documents, concepts, drafts and other materials created by Sylvia Walukiewicz as part of the service shall remain with Sylvia Walukiewicz. All material in any form created by Be You- live Your essence as part of a service or made available to the customer as part of the provision of the service may only be reproduced, published or made publicly accessible with the express written consent of Be You- live Your essence. In particular, it may not be used for similar services, revised, rewritten or changed or adapted in any other way.

9. place of performance – place of jurisdiction

Unless otherwise stated in the contract, the place of performance and payment is the registered office of Be You – live Your essence. The law of Switzerland applies to this contract. The exclusive place of jurisdiction for contracts with all our customers, suppliers and other service providers is the court responsible for the registered office of Be You- live Your essence.

10 Effectiveness of the terms and conditions

Should one or more points of these terms and conditions be or become invalid, this shall not affect the validity of the remaining points and the validity of the contract as a whole. The invalid provision shall be replaced by a provision whose effects come as close as possible to the economic objective pursued by the contracting parties with the invalid provision.
